Terms and Conditions for Rubbish Removal Holland Park

1. Definitions

2. Scope of Services

Rubbish Removal Holland Park provides waste and rubbish collection services for domestic and commercial customers within our normal service area, including Holland Park and nearby locations. The exact scope of the Services for each booking will be confirmed during the booking process, based on the information you provide.

Unless we explicitly agree otherwise in writing, the Services are limited to the loading, transport and lawful disposal or recycling of Waste that can be safely handled by our team within the agreed time, access and volume constraints.

3. Booking Process

3.1 You may request a booking by telephone, email or online enquiry. Bookings are subject to availability and are not confirmed until we provide you with a booking confirmation.

3.2 When making a booking, you must provide accurate information about the type, quantity and location of the Waste, including any heavy, bulky, hazardous or difficult items, and details of access such as stairs, parking restrictions or distance from the vehicle to the collection point.

3.3 Any quotation we provide before attending the site is based on the information given by you. If on arrival the Waste is significantly different in type or volume, or access is more difficult than described, we may revise the quotation and you may accept the revised price or decline the Service. If you decline after we have attended, a call-out or cancellation charge may apply.

3.4 Time slots are provided for guidance only. While we make reasonable efforts to attend within agreed time windows, these are not guaranteed and may be affected by traffic, weather, access or operational issues. We will aim to notify you of any significant delay or need to reschedule.

4. Pricing and Quotations

4.1 Our charges are generally based on some or all of the following: volume of Waste, weight, type of materials, labour time required, access conditions and disposal costs.

4.2 Any quotation given before the collection is an estimate only unless we state expressly that it is a fixed price. Final charges may be adjusted on site once the Waste has been inspected and measured.

4.3 All prices are stated in pounds sterling and may be subject to VAT or other applicable taxes where required by law.

4.4 We reserve the right to change our prices at any time, but any changes will not affect confirmed bookings that have already been accepted by us, save where the information you provided at the time of booking was incomplete or inaccurate.

5. Payments

5.1 Payment is due in full on completion of the Service unless otherwise agreed in writing. We may require a deposit or pre-payment for certain bookings or for commercial customers.

5.2 We accept common payment methods such as cash, bank transfer or card payment, as notified at the time of booking. We reserve the right to refuse cheques or other payment methods at our discretion.

5.3 For account or commercial customers, payment terms will be specified separately. If no separate terms are agreed, payment is due within 14 days of the invoice date.

5.4 If payment is not received by the due date, we may charge interest on the overdue amount at the statutory rate applicable to late payments, as well as any reasonable costs incurred in pursuing the debt, including legal and collection fees.

6. Cancellations and Rescheduling

6.1 You may cancel or reschedule your booking by giving us as much notice as possible.

6.2 If you cancel more than 24 hours before the scheduled arrival time, no cancellation fee will usually apply, unless we have incurred specific costs for your booking that cannot be recovered.

6.3 If you cancel within 24 hours of the scheduled arrival time, we may charge a cancellation fee to cover our administrative and scheduling costs.

6.4 If our team attends the site at the agreed time and is unable to complete the Service for reasons within your control, including but not limited to failure to provide access, incorrect address, lack of parking permission, or refusal of the updated price after a reasonable reassessment, we may charge a call-out or wasted journey fee.

6.5 We reserve the right to cancel or reschedule a booking at any time where necessary due to operational reasons, staff availability, adverse weather, vehicle breakdown, safety concerns or circumstances beyond our reasonable control. In such cases we will endeavour to offer an alternative time. We will not be liable for any loss resulting from such cancellation or delay, beyond refunding any payments already made for Services not provided.

7. Customer Obligations

7.1 You must ensure that our team has safe, reasonable and lawful access to the Waste and to your premises or site. This includes providing accurate address details, entry instructions and arranging any necessary parking permits or permissions.

7.2 You are responsible for ensuring that the Waste presented for collection is suitable for removal under these Terms and complies with all relevant laws and regulations. You must inform us in advance of any potentially hazardous, sharp, heavy or fragile items.

7.3 You must ensure that any personal or confidential items are removed from the Waste before collection. We are not responsible for any loss of valuables or personal items disposed of with the Waste.

7.4 Where we have agreed to remove items from within a property, you must ensure that passageways are reasonably clear and that the working area is safe for our staff. We may refuse to remove items if we consider that doing so would present a risk of injury or damage.

8. Excluded and Hazardous Waste

8.1 Certain types of Waste are subject to additional controls or may be excluded from our standard Services. These may include, but are not limited to: asbestos, clinical or medical waste, chemicals, solvents, oils, fuels, gas cylinders, explosives, radioactive materials, liquids or any other hazardous or specialist waste.

8.2 You must declare any such items when booking. We may be able to arrange a separate service or advise you of suitable specialist providers, but we are under no obligation to accept hazardous or prohibited Waste.

8.3 If hazardous or prohibited Waste is discovered after collection or during loading, we may refuse to remove it, or if already removed, we may return it or charge additional fees to cover specialist handling and disposal costs. You will be responsible for any legal or regulatory consequences arising from your failure to disclose such Waste.

9. Performance of the Service

9.1 Our team will carry out the Services with reasonable care and skill and in a professional manner.

9.2 We may take photographs of the Waste before and after collection for record-keeping, waste transfer documentation and proof of service. These images will not be used for marketing without your permission, except where the property is not reasonably identifiable.

9.3 We reserve the right to refuse to carry or remove any item that we reasonably believe cannot be moved safely due to its size, weight, condition, location or risk to persons or property.

10. Waste Regulations and Duty of Care

10.1 Rubbish Removal Holland Park operates in accordance with applicable UK waste legislation and regulations. We aim to dispose of and recycle Waste in a lawful and environmentally responsible manner.

10.2 Where required, we will issue a waste transfer note or similar documentation. You should retain any such documents as part of your duty of care obligations.

10.3 You confirm that you have the right to transfer the Waste to us and that it does not contain items that are illegal to possess, transfer or dispose of.

10.4 Once the Waste has been loaded into our vehicle, ownership and responsibility for it passes to us, except where the Waste is later identified as hazardous or prohibited and we are required to return it or otherwise deal with it in compliance with law.

11. Liability and Limitation

11.1 We will take reasonable care when carrying out the Services. However, minor scuffs or marks may occur when removing large or awkward items. We will not be liable for minor cosmetic damage that could not reasonably be avoided when carrying out the Services with proper care.

11.2 We will not be liable for any damage caused as a result of defective or insecure premises, including weak floors, walls, staircases, paths, driveways, or hidden pipes and cables, unless caused by our negligence.

11.3 If we damage your property due to our negligence, you must notify us in writing as soon as reasonably practicable and in any event within 7 days of the Service. Our liability will be limited at our option to repairing the damage, arranging for a third party to repair it, or paying the reasonable cost of repair, subject to proper evidence being provided.

11.4 We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

11.5 Subject to the above, our total liability to you arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the amount paid or payable by you for the specific Service giving rise to the claim.

11.6 We will not be liable for any indirect or consequential loss, loss of profits, loss of business, loss of opportunity or loss of data arising out of or in connection with the Services or these Terms and Conditions.

12. Complaints

12.1 If you are dissatisfied with any aspect of our Service, you should contact us as soon as possible with details of your concern.

12.2 We will investigate complaints promptly and aim to reach a fair resolution. You agree to allow us reasonable access and opportunity to inspect any alleged damage or issue before any remedial work is carried out by a third party.

13. Force Majeure

13.1 We shall not be liable for any delay or failure to perform our obligations under these Terms and Conditions where such delay or failure results from events, circumstances or causes beyond our reasonable control, including but not limited to extreme weather, road closures, accidents, strikes, civil disturbance, acts of terrorism or failure of utilities.

14. Data Protection and Privacy

14.1 We will handle any personal information you provide in accordance with applicable data protection laws. Information will be used to manage your booking, provide the Services, handle payments and, where applicable, to meet legal and regulatory requirements.

14.2 You are responsible for ensuring the accuracy of the personal data you provide and for informing us of any updates.

15. Variations

15.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that booking.

15.2 Any variations to these Terms and Conditions proposed by you shall only be valid if agreed in writing by an authorised representative of Rubbish Removal Holland Park.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any non-contractual obligations arising out of or in connection with them, are governed by and shall be construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable, and the remaining provisions shall continue in full force and effect.

17.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

17.3 You may not assign or transfer your rights or obligations under the Agreement without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary to provide the Services.

17.4 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between you and Rubbish Removal Holland Park in relation to the Services and supersede any prior discussions, correspondence or understandings.
